The appeal of John Rutter in the well famous Cameron Diaz Photo shoot case was rejected on Monday.

John Rutter is the photographer who took Cameron’s topless photos when she was 19 and tried to coerce her into buying them back for $3.5 million after she became famous.

He was convicted previous year for attempting grand theft, forgery and perjury for these topless photographs and serving a 4-year sentence in jail.

Although these topless photos were never published, Rutter is prohibited by the judge to release the pictures and the video of the shoot.

The alleged photographer had filed an appeal and had testified during his trial that he offered Diaz a deal to pay him $3.5 million for these pictures before he shopped them to a prospective buyer for a campaign. He stated that he was only offering her the first right of refusal, not trying to blackmail her.
