40,243 cases pending in Supreme Court, 3,991,251 cases pending in 21 high courts: Law Minister

‘Justice delayed is Justice denied’ is the old phenomenon in India. This has become the characteristic of Indian legal system. It takes so many years to start trail in the lower court and takes many more years to reach on the final Judgment. Here is the example of the delaying justice in India legal system.

The Supreme Court has opposed the demand for establishing its new benches elsewhere in the country. There is a backlog of more than 40,000 civil and criminal cases in the Supreme Court. It has increased by 25 percent in last one year. But still, the apex court has refused to set up its bench anywhere in the country.

H.R. Bhardwaj, the minister for Law and Justice has told to MPs in Lok Sabha till Jan 31, 2007, a total of 40,243 civil and criminal cases were pending in the apex court. Supreme Court.

Last year, the Supreme Court has seen rise of 25 percent in the number of pending cases in 2206. According to the statistics, the no. of such cases was around 29,000 in the start of the year 2006.

On another question asked for setting up new benches of the apex court, the minister said that the court has been consistently opposing the proposal. The government had proposed to set up some benches of the apex court in the southern and other regions of the country.

He said further that various parliamentary panels have recommended on many occasion for the need of new benches of the apex court to clear the pending cases. The minister said further that data shows that a total of 3,991,251 cases (3,287,037 civil cases and 704,214 criminal cases) were still pending in 21 high courts of the country till Dec 31, 2006.

However, the data shows also that no. of pending cases in the apex court was reduced from 104,936 cases in 1991 to 19,806 cases in 1998.

The ministry of Law and Justice has taken many steps to fight with this problem such as increasing the number of judges from time to time and setting of fast track courts to facilitate faster disposal of pending cases. But it needs faster disposal of the pending cases across the country for on time delivery of justice to the people.
