Despite a claim by her lawyer-turned-partner, Howard K. Stern, late Anna Nicole Smith’s two personal diaries written in the early 1990s are being auctioned. Stern insists that the diaries are stolen property and he wants them to be returned to him.

An attorney of playboy playmate’s partner has written a letter to Doug Norwine, the director of music and entertainment memorabilia at Heritage Auction Galleries of Dallas, claiming that the two diaries were stolen and therefore belong to Stern.

The auction house obtained the two personal diaries, a $16,954.66 receipt of Bloomingdale’s shopping spree in 1992, a signed bank check from Smith and her 1994 Texas photo ID card from an anonymous German businessman who bought the items from auction site eBay for more than $500,000 several weeks ago.

Norwine clarified that the belongings of Anna Nicole Smith were legally obtained by a celebrity memorabilia dealer in Los Angeles before they went up for sale on eBay. He confirmed that the auction will happen, if it is not stopped by the court.

The diaries, from 1992 and 1994, cover issues ranging from Smith’s love for octogenarian oil tycoon J. Howard Marshall to concerns about her eating disorder.

The opening bids will start at $20,000 and the auction is expected to fetch as much as $100,000.
